In law, “damages” are a type of remedy meant to be paid to a claimant, or the “plaintiff” or person making the claim in a lawsuit, as a way to compensate them for a loss or injury. In order to warrant the award, the plaintiff must prove that a breach of duty on the part of the “defendant”, or the person being sued in the lawsuit, caused a foreseeable loss or injury to the plaintiff. This loss must involve damage to property, or a physical or mental injury. It is rare that a purely economic loss is used for the award of damages. Learn more about the types of damages in a personal injury lawsuit below.
Economic Damages vs Non-economic Damages
The first category of damages that can be recovered after an injury are economic damages. Economic, or ‘specific’ damages are meant to provide the plaintiff with compensation for measurable losses. These can include:
- Past and future medical expenses
- Wages lost due to an injury
- Loss of future earning capacity
- Loss of home services
- Costs associated with replacing or fixing damaged property
In the majority of personal injury situations, the largest part of the damages awarded are typically meant to compensate for medical expenses, such as:
- Hospital bills
- Ambulance bills
- Physical therapy
- Psychological therapy
The second category of damages is noneconomic damages. Also known as ‘general’ damages, these are not measurable, which means they can’t be accounted for with medical bills, repair costs, etc. Examples of non-economic damages are:
- Pain and suffering
- Emotional distress
- Loss of enjoyment of life
Damages in Colorado
The damages available under Colorado law can vary depending on the nature of the case, and there are a number of laws governing the amount of time a plaintiff has to bring a lawsuit, and even laws capping the amount that a plaintiff can be awarded.

I don’t know where I would be without the Law Offices of Robert Paysinger. It was a very emotional experience, and I feel as if I owe Mr. Paysinger my life! The other lawyers would promise everything, but it was only here that I felt his integrity and willingness to live up to his word. He and the paralegals were so incredibly helpful throughout the strenuous process of my case. Going through a lawsuit is an emotional roller coaster, but whenever I was confused they would sit and explain everything in terms that I could understand. They provided an emotional support and treated me like family. It’s never about the money there, but about you, if you are upset they will do everything to help you, and work extremely hard for you. They are extremely honest and straight forward. I would recommend Mr. Paysinger to everyone, because they truly and genuinely care about you.
